These App Terms of Service ("App Terms") govern your use of the Travel by Fresnaye mobile application ("App"), operated by Travel by Fresnaye, a division of Fresnaye & Company LLC ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these App Terms and our App Privacy Policy. These App Terms supplement — and do not replace — the Travel by Fresnaye Website Terms of Service, which also apply to your engagement with our services.
If you do not agree to these terms, do not install or use the App.
Subject to your compliance with these App Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal use in connection with our travel advisory services.

If you enable biometric authentication (Face ID / Touch ID), you acknowledge that this feature is provided by your device's operating system and biometric data is processed entirely on-device — it is never transmitted to us.
We reserve the right to suspend or terminate accounts for violations of these terms, suspected fraud, or inactivity exceeding 24 months.

Not all services available through our website are available in the App. Features are subject to change. We may add, modify, or remove App features at any time without notice, though we will make reasonable efforts to communicate material changes.
The App offers a feature that allows you to forward travel confirmation emails to be parsed and imported into your itinerary. By using this feature, you acknowledge and agree that:
This feature is optional. You may always add trip details manually through your advisor or the App's manual entry options.
Bookings initiated or managed through the App are subject to the full booking, payment, and cancellation terms set out in the Website Terms of Service. Key points:

You may delete your account at any time from within the App via Settings → Account → Delete Account. Deletion is permanent. Upon confirmation:

Violations may result in immediate account suspension and, where appropriate, reporting to relevant authorities.
The App and all of its content — including design, code, graphics, logos, copy, and itinerary layouts — are the property of Fresnaye & Company LLC or its licensors. Nothing in these terms grants you any ownership interest in the App.
Content you submit through the App (such as travel preferences, loyalty numbers, or documents) remains yours. By submitting it, you grant us a limited license to use it solely to provide the App's services to you.
The App integrates third-party services including OpenWeatherMap, Microsoft Graph, and the Anthropic Claude API (server-side). These services operate under their own terms and privacy policies, which you are encouraged to review. We are not responsible for the practices of third-party service providers beyond our agreements with them.
Links or references within the App to third-party content do not constitute an endorsement by Travel by Fresnaye.
The App is distributed through the Apple App Store and Google Play Store. Your download and use of the App is also subject to the applicable platform terms:
The App is provided on an "as is" and "as available" basis. We make no warranties — express or implied — regarding the App's availability, accuracy, fitness for a particular purpose, or freedom from errors or interruptions.
Weather information displayed in the App is sourced from OpenWeatherMap and is provided for general informational purposes only. We are not responsible for decisions made based on weather data displayed in the App.
Trip data imported via the email import feature is parsed automatically and may contain errors. Always verify imported details against your original booking confirmations.
To the maximum extent permitted by applicable law, Travel by Fresnaye and Fresnaye & Company LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to data loss, service interruptions, or errors in imported trip data.
Our total liability for any claim arising from your use of the App shall not exceed the greater of (a) the fees paid directly to Travel by Fresnaye in the 12 months preceding the claim, or (b) $100 USD.
These limitations apply regardless of the legal theory on which the claim is based and even if we have been advised of the possibility of such damages.
These App Terms are governed by the laws of the District of Columbia, United States of America. For users in the United Kingdom, English law shall apply to the extent required by mandatory consumer protection regulations.
Nothing in these terms limits your statutory rights as a consumer under the laws of your country of residence.
We may update these App Terms as the App evolves or as required by applicable law. We will notify you of material changes via an in-app notification and/or email before the changes take effect. The updated terms will reflect a new effective date.
Continued use of the App after the effective date of any updated terms constitutes your acceptance.
